{"id":69873,"date":"2018-10-02T09:40:56","date_gmt":"2018-10-02T07:40:56","guid":{"rendered":"http:\/\/www.times.mw\/?p=69873"},"modified":"2018-10-02T09:40:57","modified_gmt":"2018-10-02T07:40:57","slug":"lilongwe-city-council-u-turns-on-area-18-case","status":"publish","type":"post","link":"https:\/\/archive.times.mw\/index.php\/2018\/10\/02\/lilongwe-city-council-u-turns-on-area-18-case\/","title":{"rendered":"Lilongwe City Council U-turns on Area 18 case"},"content":{"rendered":"<p><strong><em>By Audrey Kapalamula:<\/em><\/strong><\/p>\n<p><a href=\"http:\/\/www.times.mw\/wp-content\/uploads\/2017\/10\/charles-mhango.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-medium wp-image-54488\" src=\"http:\/\/www.times.mw\/wp-content\/uploads\/2017\/10\/charles-mhango-300x162.jpg\" alt=\"\" width=\"300\" height=\"162\" srcset=\"https:\/\/archive.times.mw\/wp-content\/uploads\/2017\/10\/charles-mhango-300x162.jpg 300w, https:\/\/archive.times.mw\/wp-content\/uploads\/2017\/10\/charles-mhango.jpg 675w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/a>Lilongwe City Council (LCC) has rescinded its decision to go for a full trial and reverted to court mediation in the case which <a href=\"https:\/\/www.times.mw\/area-18-taskforce-for-re-assessment-of-victims\/\">Area 18 victims<\/a> of water contamination are seeking compensation in the capital city.<\/p>\n<p>Earlier, the court mandatory mediation collapsed after lawyers from the three parties, including Malawi Housing Corporation (MHC) and Lilongwe Water Board (LWB), agreed that the planned mediation would flop.<\/p>\n<p>But Chancy Mwalubunju, Executive Director for Lawyers Forum for Human Rights representing the victims, said the council made a U-turn on the matter when the forum was processing to get consent to have the matter in court.<\/p>\n<blockquote><p><em>\u201cAfter we got the documents for their consent to have the case on full trial, they got a piece of advice from their client to go back to the mediation arrangement,\u201d<\/em> he said.<\/p><\/blockquote>\n<p>Attorney General Charles Mhango is representing the Council. LCC authorities and Mhango were not available for a comment as went to press.<\/p>\n<p>Mwalubunju said the development means that LWB and MHC must follow the mandatory mediation.<\/p>\n<blockquote><p><em>\u201cIf there is no consent from both parties, the two institutions are supposed to appear before the court. Even though they have a different position from that of LCC, they still have to come for mediation,\u201d<\/em> he said<\/p><\/blockquote>\n<p>Mwalumbunju said the parties are waiting for the court to determine the date on which to proceed with the matter.<\/p>\n<p>At least 1,300 people are seeking compensation from the three institutions after drinking sewer-contaminated water in July 2017.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>By Audrey Kapalamula: Lilongwe City Council (LCC) has rescinded its decision to go for a full trial and reverted to court mediation in the case which Area 18 victims of water contamination are seeking compensation in the capital city.
