The Public Accounts Committee (Pac) of Parliament has asked the Office of President and Cabinet (OPC) to review the structure of Malawi Law Commission, a development that would allow the commission to have in place an audit committee.
\nIn the audit report of 2014\/2015 financial year, the office of Auditor General observed that the commission does not have the committee.
\nBut Law Commissioner, Getrude Hiwa, attributed the development to the absence of a corporate body that would form the committee.
\nHiwa said, in the current set-up, the commission cannot establish an internal audit committee as the commission structure comprises a commissioner and members of staff.
\n\u201cWhen we have a programme, for instance, the review of electoral laws, we have a special law commission with members who we refer to as commissioners. Once the programme is done they are discharged. In the case of Malawi Human Rights Commission, they have full-and part-time commissioners. Therefore, they draw their membership of the committee from the commissioners. In our case, we cannot do that,\u201d he said
\nPac Chairperson Alekeni Menyani said an audit committee is crucial in government institutions in as far as governance is concerned.
\nMenyani has since asked OPC to review the commission\u2019s structure.
\n\u201cThere are corporate governance rules that govern how every organisation must operate. In the manner in which the commission is structured is not the fault of the commission. It makes very difficult for anybody to oversee their financial operation, it\u2019s like it\u2019s an institution that none can touch,\u201d he said<\/p>\n","protected":false},"excerpt":{"rendered":"
