The High Court in Lilongwe has given Malawi Housing Corporation, Lilongwe City Council (LCC) and Lilongwe Water Board (LWB) 14 days to pay damages to residents of Area 18 in Lilongwe or contest their liability in court over the supply of contaminated water to the residents.<\/p>\n
This follows failure by the institutions to comply with the demands that the residents made through their lawyers in August 2017.<\/p>\n
The residents are demanding K4 million each as compensation for consuming sewer-contaminated water in July 2017.<\/p>\n
The court delivered the writ on September 5 2017.<\/p>\n
\u201cWe command you within 14 days after service of this writ on you inclusive of the day of service, you must either satisfy the claim or file with this court a defence and list of documents,\u201d reads the summon<\/p>\n
The court has further told the three institutions that if they do not intend to contest the proceedings, within seven days they should return accompanying acknowledgement of service to the appropriate service registry stating that they do not intend to contest proceedings but desire a stay of execution.<\/p>\n
\u201cIf you fail to satisfy the claim or to file a defence and list of documents or to return acknowledgement within the time stated, or if you return the acknowledgement without stating therein an intention to contest the proceeding, the plaintiff may proceed with action and judgment may be entered against you without further notice,\u201d reads part of the summon<\/p>\n
