Residents of Area 18 in Lilongwe have included Malawi Housing Corporation (MHC) to a number of institutions that they have dragged to court in a case they are demanding K4 billion in compensation over the supply of water that was contaminated with sewage.
\nThe other institutions are Lilongwe City Council and Lilongwe Water Board (LWB).
\nExecutive Director for Lawyers\u2019 Forum for Human Rights that is representing the group Chance Mwalubunju said they have filed court summons against the institutions for failing to comply with the seven days deadline.
\nThe residents are demanding K4 million each from the institutions for being supplied with sewer-contaminated water in July.
\nMwalubunju said the council has responded by denying liability while pushing the blame to MHC. However, LWB is yet to respond to the matter.
\n\u201cWe have filed the documents: We are waiting for the court to issue the summons. Upon being given the summonses, we will deliver them to the three institutions. The court will have to determine who is liable for the water contamination, Is it only water board or all of them? After the court determination next step will be who is going to pay the compensation,\u201d he said
\nHe further said MHC has been included after discussing its involvement in the saga.
\n\u201cWe issued a press release about 14 to 21 days ago and they are aware of the situation, that\u2019s why after discussing, we have not given them the same period to respond. It will also delay the process because if you start with a certain party in court, then to include another party you have to ask the court for a leave, so the case delays more. They also took an active part after Parliament also asked them to maintain the broken pipe,\u201d he said
