{"id":26585,"date":"2016-06-21T09:31:52","date_gmt":"2016-06-21T07:31:52","guid":{"rendered":"http:\/\/www.times.mw\/?p=26585"},"modified":"2016-06-21T09:31:52","modified_gmt":"2016-06-21T07:31:52","slug":"comesa-court-under-utilised","status":"publish","type":"post","link":"https:\/\/archive.times.mw\/index.php\/2016\/06\/21\/comesa-court-under-utilised\/","title":{"rendered":"Comesa Court under-utilised"},"content":{"rendered":"<p>The Common Market for Eastern and Southern Africa (Comesa) says although the Comesa Court of Justice was established to adjudicate upon all disputes between countries operating within the regional bloc, the organ is being underutilised because the business community and governments are not well informed about its functions and jurisdiction.<\/p>\n<p>The Comesa Court of Justice is the judicial organ of Comesa through which member states and other stakeholders can seek redress for any damages or disputes which may arise as a result of the Comesa integration process.<\/p>\n<p>But a statement from Comesa Secretariat says since inception, the court, with headquarters in Khartoum, Sudan is hardly used by its stakeholders; principally, the business community and governments.<\/p>\n<p>Comesa says it has now embarked on a sensitisation campaign in countries which are members of the regional economic bloc to sensitise governments and business communities on the roles of the Comesa Court of Justice in deepening regional integration.<\/p>\n<p>Under the programme, Comesa aims at informing law practitioners, government officials, the business communities and other stakeholders about the remedies that the Comesa Court of Justice can afford to litigants in an effort to promote trade developments regarding the region and the continent in addition to provisions and applications of the Comesa Treaty.<\/p>\n<p>\u201cThe Comesa Court of Justice is the judicial organ of Comesa whose core function is to adjudicate upon all disputes between Member States that would arise from the interpretation and application of the Comesa Treaty. Since inception, the Court has been underutilised. Nevertheless, the court has been cited for its landmark rulings and advisory opinions which have reassured the business community of final redress where possible disputes are likely to occur with government and other parties,\u201d part of the statement reads.<\/p>\n<p>In 2013, the court ruled in favour of a private company Polytol Paints in a matter involving the company and the State of Mauritius.
