Limbani Banda loses case

Controversial reggae artist Limbani Banda, who rebranded to Lambanie Dube, on Tuesday lost a court case and was told to pay back K1 million.

The K1 million is repayment for his failure to adhere to terms of a musical contract.

The ruling of the case was made by the Zomba Senior Resident Magistrate Court in Zomba.

According to court documents, the plaintiff, who was represented by lawyer Jai Banda, is said to have paid Lambanie Dube K1 million to invite an international musician to perform for them as a fundraising activity.

The reggae artist famed for the hit ‘Chisoni Nkumatenda’ is said to have been engaged to assist in inviting Zambian artist General Kanene.

According to court documents, the dreadlocked artist was paid K1 million in instalments of K750, 000 and K250,000 respectively but the controversial Zambian artist never came to perform.

The documents indicate that the artist denied the claim before both parties testified and paraded witnesses.

In his testimony, the artist stated that the plaintiff failed to organise the show and that it did not take place.

Lambanie Dube also indicated that there was no musical performance by local artists at Robin’s Park in Blantyre on November 19 and that, as such, it was pointless to bring Kanene to a venue that was hosting no event.

And as regards refunding the money, the artist contended that there was no agreement between him and the plaintiff indicating that the money was refundable.

The artist went on to explain that if a show fails to take place money given to an artist is not refundable but the artist is given another chance to perform.

But Senior Resident Magistrate Wyson Chamdimba said the artist failed to adhere to the terms of the contract, hence he must honour his part of the agreement by repaying the K1 million.
