Court documents The Daily Times has seen show that disagreements in opposition Malawi Congress Party (MCP) are far from over.
The documents show that there is a case in which 27 party officials are demanding that the party’s Secretary General, Gustave Kaliwo, should call for an emergency convention to regularise changes that party president Lazarus Chakwera made to the National Executive Committee (Nec) on August 27, 2015.
The High Court is expected to make a ruling on the matter on March 17, 2016.
Judge Chifundo Kachale is presiding over the case in which lawyer, John Gift Mwakhwawa, is representing the MCP while Wesley Namasala is counsel for the MCP officials.
Both Namasala and Mwakhwawa confirmed the date in separate interviews but said they could not comment on how the case has been progressing urging the reporter to wait for March 17.
According to originating summons sent to Kaliwo, dated October 28 2015, Lackson Khamalatha demanded an emergency convention.
“By this summons, which is issued on the application of the plaintiffs, Lackson Chimangeni Khamalatha and 26 others, of C/O… claim against the respondent for: (1) an order that the respondent call for an emergency convention within reasonable time for reasons explained in the affidavit (2) an order for costs of this action,” reads the summons taken out by Lincoln Edward & Company.
An affidavit by Khamalatha shows that there are 27 officials against the reshuffle Chakwera made to the party’s Nec.
Khamalatha also says the reshuffle created positions that can only be regularised at a convention.
“That it is against the background of such constitutional irregularities that necessitated us to write the Secretary General of the Malawi Congress Party, pursuant to Article 40 of the constitution demanding an emergency convention,” reads the summons.
